1. Use

Chef and Guests, as an online marketplace, connects individuals with private chefs to perform cooking services at their homes or a chosen venue. Chef and Guests do not intend to carry out the Services themselves. The services are carried out directly by private chefs, external agents outside Chef and Guests, who have no subordination relationship with Chef and Guests, and under their full and direct responsibility. The role of Chef and Guests is limited to the presentation and promotion of these private chefs on the website and other social media platforms. Chef and Guests may modify the features of its services at any time and terminate the service, or temporarily or permanently interrupt access to all or part of the Website (including for technical reasons). Chef and Guests reserve the right to modify the website and the present Terms & Conditions. Chef and Guests may, in its sole discretion, change this agreement or any part thereof at any time without notice.

2. Liability

This website is run by Chef and Guests based in South Africa trading as Chef and Guests (Pty) Ltd and with registration number (2018/335351/07). The performance of a service is solely the result of an agreement between an individual and a private chef. The latter shall act under their sole and absolute responsibility. As such, the performance of a service does not bind Chef and Guests in any way whatsoever. The role of Chef and Guests is exclusively the connection between an individual and a private chef. If it is impossible for the private chef to honour a scheduled booking, Chef and Guests will make their best efforts to propose an alternative chef or an alternative date. Any claim relating to a service should be sent by email to info@chefnguests.co.za. This website is governed by the laws of South Africa and Chef and Guests chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature. 3. Gift Vouchers

Our Gift vouchers cannot be redeemed or exchanged for cash. Our Gift vouchers are only valid in Johannesburg, Pretoria, Durban and Cape Town. Our Gift vouchers are only applicable to one dinner/lunch booking per voucher. Our Gift vouchers are subject to the availability of chefs upon booking.

4. Payment

Once an invoice has been accepted, the total amount quoted should be paid within 24 hours. No service will be rendered before the total amount has been paid. If any delivery of products is part of the agreed service(s) rendered, subject to availability and receipt of payment, requests will be processed within 2 working days and delivery confirmed by way of email communication. Payment may be made via Visa and MasterCard. Online card transactions will be acquired for Chef and Guests via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR). Customer details will be stored by Chef and Guests separately from card details which are entered by the client on PayGate’s secure site. 5. Cancellation

The provision of goods and services by Chef and Guests is subject to availability. In cases of unavailability, Chef and Guests will refund the client in full within 7 days. If you cancel your booking one week before the scheduled date, you will be fully refunded. If you cancel your booking between 72 hours and one week before the scheduled date, we will refund you 50% of the amount paid. There will be no refund if you cancel your booking less than 48 hours before the scheduled date. Please note that this refund policy with regards to cancellation excludes the Booking Fee which is non-refundable for any cancellation.

6. Customer Privacy Policy

Chef and Guests shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).
